1. Agreement to These Terms

By accessing this website or placing an order, you agree to these Terms & Conditions / Waiver of Liability and the policies linked from this website. If you do not agree to these terms, please do not use this website or place an order.

2. Products, Orders, and Pricing

We make reasonable efforts to keep product descriptions, prices, availability, and other information accurate. However, errors may occur. GainGround Co. LLC reserves the right to correct errors, update information, change availability, or cancel an order when necessary. If we cancel an order after payment has been received, we will refund the amount paid for the canceled order.

3. All Sales Final

All purchases from GainGround Co. LLC are final. We do not accept ordinary returns or issue refunds except in the case of a verified product defect. If you receive a defective product, please contact us at contact@gaingroundco.com within 7 days of delivery with documentation of the defect. Approved defect claims may receive a replacement or store credit at GainGround Co. LLC’s sole discretion, subject to applicable law.

This policy does not limit any consumer right or remedy that cannot legally be waived.

4. User Responsibility

GainGround Co. LLC is not responsible for errors made by the purchaser in the use, application, or implementation of any product. By purchasing, you acknowledge that you have reviewed the product description and that errors resulting from your own use do not constitute a product defect and are not eligible for a refund or replacement, subject to applicable law.

5. Custom and Customer-Submitted Content

For custom puzzles, personalized products, and other products that use information or files you submit, you are responsible for the accuracy, completeness, and legality of the content you provide. You represent that you have the right to use any names, text, photographs, artwork, or other materials you submit and that your content does not infringe another person’s rights or violate applicable law.

You grant GainGround Co. LLC permission to use submitted content only as reasonably necessary to create, fulfill, support, and service your order. We may refuse or cancel an order that contains content we reasonably believe is unlawful, infringing, abusive, or inappropriate.

6. Digital Products

Digital products are delivered electronically. Unless the product listing states otherwise, your purchase grants you a single-user, non-transferable license to use the file for personal or internal business purposes. The purchase does not transfer ownership of the digital product or its underlying intellectual property.

You may not resell, redistribute, sublicense, reproduce, publish, or publicly share digital files, in whole or in part, except as permitted by law or expressly authorized by GainGround Co. LLC. Download limits or delivery conditions shown with a digital product apply to that product.

For spreadsheet templates, the template and its underlying formulas, layouts, and formatting are the proprietary intellectual property of GainGround Co. LLC. You may not resell, redistribute, sublicense, or publicly share a spreadsheet template, in whole or in part, in any format.

Spreadsheet templates are designed specifically for use with Microsoft Excel. Your purchase does not include a license to Microsoft Excel software. You are responsible for securing and maintaining a valid, compatible commercial or personal subscription to Microsoft Excel to open, use, or edit the file. GainGround Co. LLC is not responsible for file incompatibility arising from the use of alternative, non-Microsoft spreadsheet applications, including, by way of example and without limitation, Google Sheets or Apple Numbers.

If you cannot access a digital product or receive a materially defective file, please contact us at contact@gaingroundco.com so we can review the issue and, where appropriate, provide a corrected or replacement file.

7. Educational Purpose Disclaimer

All products offered by GainGround Co. LLC are intended for educational and informational and organizational purposes only. Nothing contained in any product constitutes or should be construed as legal advice, financial advice, medical advice, or professional guidance of any kind. You should consult a qualified professional before making any decisions based on information contained in these products. GainGround Co. LLC assumes no liability for actions taken based on product content.

8. Limited Warranty and Limitation of Liability

To the fullest extent permitted by law, products are provided on an “as is” and “with all faults” basis. GainGround Co. LLC disclaims all express, implied, and statutory warranties, including the implied warranties of merchantability and fitness for a particular purpose, except to the extent that such warranties cannot legally be excluded.

To the fullest extent permitted by law, GainGround Co. LLC shall not be liable for indirect, incidental, special, consequential, or exemplary damages, including damage to other property, arising out of or related to the use or performance of a product, even if GainGround Co. LLC has been advised of the possibility of such damages. In no event shall GainGround Co. LLC’s total liability exceed the amount you actually paid for the product giving rise to the claim.

9. Waiver of Liability

To the fullest extent permitted by law, you agree to release and hold harmless GainGround Co. LLC, its owners, employees, and affiliates from claims, demands, causes of action, damages, losses, or expenses, including reasonable legal fees, arising out of or related to your purchase or use of a product, except for rights or liabilities that cannot legally be waived or limited.

10. Intellectual Property

All website content, product content, designs, text, graphics, branding, templates, and other materials provided by GainGround Co. LLC are owned by or licensed to GainGround Co. LLC and are protected by applicable intellectual-property laws. You may not copy, modify, sell, distribute, or create derivative works from these materials without permission, except for permitted personal use of a purchased product.

Those policies are part of the terms that apply to your use of this website and your purchases.

GainGround Co. LLC reserves the right to update these Terms & Conditions at any time. Changes are effective upon posting. Continued use of the website or placement of an order after changes are posted constitutes acceptance of the updated terms, to the extent permitted by law.
